Cancellation and Returns Policy

You can cancel an order and return the unopened CD package within 10 days of purchase and we will provide a full refund less any postage costs. Our Terms and Conditions do not affect your statutory rights.

WiNAiM™ License Agreement

Your opportunity to withdraw:

All WiNAiM™ Systems programs are protected by copyright and on the condition that the purchaser or lawful acquirer (referred to here as 'the customer') of every copy of the programs agrees to the terms of this Licence Agreement. Please read the following terms and conditions carefully. If the Customer does not agree to be bound by this Licence Agreement, return the unopened package with proof of purchase to the place of the purchase within 10 days and the purchase price will be promptly refunded. The Customer may be held legally liable for any use of the programs and documentation that is not in accordance with this Agreement and in certain circumstances this may involve criminal prosecution.

 

Licence Agreement:

License Agreement for WiNAiM™ for use in the UK and the European Union only. For use with Microsoft Windows Server 2003 and 2008.

1. Grant of License. This is a legal agreement between you (either an individual, a single entity or a company) and BatonBos Ltd and Winfoware Technologies Ltd (hereby known as BB and WTL) for the WiNAiM™ software described above. This agreement provides rights to access or use the Software residing on your server(s).

2. Reservation of Rights. BB and WTL reserves all rights not expressly granted to you in this agreement and this agreement will not be construed as granting any other rights, whether by implication or otherwise. Notwithstanding any other provision of this agreement, this agreement does not grant a license under any BB and WTL intellectual property, to implement any functionality contained in the software (including, without limitation, communication protocols used by the software) in any software installed on a device accessing or utilising the software.

3. Termination. Without prejudice to any other rights, BB and WTL may terminate this agreement if you do not abide by the terms and conditions herein.

4. Not for resale software. Software identified as "Not for Resale" may not be resold, transferred or used for any purpose other than demonstration, test or evaluation.

5. Academic Edition Software. To use Software identified as "Academic Edition", you must be a "Qualified Educational User". More details on this topic can be obtained from BB and WTL or the distributor serving your country.

6. Disclaimer of Warranties. To the maximum extent permitted by applicable law, BB and WTL and its suppliers provide this Software AS IS AND WITH ALL FAULTS, and hereby disclaim all other warranties and conditions, whether express, implied or statutory, including, but not limited to, any implied warranties or conditions of merchantability, of fitness for a particular purpose, of accuracy or completeness of responses, of results, of workmanlike effort, of lack of viruses, and of lack of negligence, all with regard to the Software. Also, there is no warranty or condition of title, quiet enjoyment, quiet possession, correspondence to description, or non-infringement with regard to the Software.

7. Exclusion of Incidental, Consequential and certain other damages. To the maximum extent permitted by applicable law, in no event shall BB and WTL or its suppliers be liable for any special, incidental, punitive, indirect or consequential damages whatsoever (including, but not limited to, damages for loss of profits or confidential or other information, for business interruption , for personal injury, for loss of privacy, for failure to meet any duty including of good faith or of reasonable care, for negligence and for any other pecuniary or other loss whatsoever) arising out of or in any way related to the use of or inability to use the Software , or otherwise under or in connection with any provision of this Software, even in the event of the fault, tort(including negligence), misrepresentation, strict liability , breach of contract, or breach of warranty of BB and WTL or any supplier, and even if BB and WTL or any supplier has been advised of the possibility of such damages.

8. Limitation of Liability and Remedies. Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced herein and all direct or general damages in contract or anything else), the entire liability of BB and WTL and any of its suppliers under any provision of this Software and your exclusive remedy for all of the foregoing shall be limited to the greater of the actual damages you incur in reasonable reliance on the Software up to the amount actually paid by you for the Software. The foregoing limitations, exclusions, and disclaimers (including sections 6 & 7) shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.

9. Applicable Law. If you acquired this Software in Great Britain, this agreement is governed by the laws of Great Britain.

10. Entire Agreement. This agreement represents the entire agreement between you and BB and WTL relating to the Software and supersedes any prior or contemporaneous oral or written communications, proposals and representations with respect to the Software or any other subject matter covered by this agreement.
